Fludo (Fludo.ai) is an Endurance Sports Digital Exchange operating on a multi-tenant SaaS architecture. This Privacy Policy describes how we collect, use, store, and safeguard your information.

2.1 Account & Authentication Data

We collect:

• Mobile number for OTP login
• Optional identity verification (Aadhaar, PAN, or similar)

You agree to provide accurate and lawful information.

2.2 Fitness & Health Data (User-Provided)

If you choose to sync or upload data from Strava, Garmin, or similar platforms, we may process:

• Distance, pace, HR, cadence
• Stride length, VO2max
• Daily workouts and historical performance

You acknowledge that such data is voluntarily provided.

2.3 Profile & Performance Data

We collect data to create a permanent profile with an authenticated UID, ranking, and score.

• Running history
• Rankings, scores, AI-generated personas
• Event participation and race calendar

• Provide AI-based analytics and persona mapping

4.1 Limited Sharing With Platform Stakeholders

We share only what is necessary to enable platform functionality:

• With Platform Stakeholders: We facilitate communication between Athletes, Coaches, Event Organizers, and Merchants.
• With Merchants and Vendors: B2B partners may be provided access to anonymized demographic and geographical data.
• Event Organizers: Organizers may access data for race timing technologies and post-race analysis.

4.2 No Unauthorized Disclosure

We do not disclose your identifiable data to third parties without your consent, except where required by law.

5. Data Security

We implement commercially reasonable security measures. However, no system is completely secure, and you acknowledge inherent risks associated with digital platforms.

6. User Rights

You may:

• Access and update your data
• Request account deletion
• Control visibility settings
• Block or report other users

7. Retention

We retain data only as long as necessary for operational, legal, or security purposes.

Fludo is not intended for users under 13.

2. TERMS OF SERVICE

By accessing Fludo, you agree to these Terms. If you do not agree, you must discontinue use immediately.

2. User Accounts

• You must register using a valid mobile number.
• You are responsible for safeguarding your login credentials.
• You must provide accurate information and update it as necessary.

Fludo is not liable for unauthorized access resulting from your negligence.

3. Platform Usage

• Users can utilize the platform to follow events, track performance, and communicate via one-on-one or group chats.
• Users are permitted to create social media posts to share their achievements (e.g., flaunting bibs, medals, personal bests).
• Any form of harassment, misconduct or misrepresentation is strictly prohibited. Users have the ability to block and report others for misconduct.

4. Platform Role & Limitations

Fludo is a digital facilitator only.
We do not:

• Guarantee the quality of third-party goods or services
• Provide logistical or ground support for any event
• Endorse or promote any specific Coach, Merchant, or Organizer
• Verify the accuracy of Partner-generated content

You acknowledge that all third-party interactions are at your own risk.

5. User-Generated Content

You are solely responsible for the content you publish.
Fludo does not pre-screen or verify such content.
We may remove content that violates these Terms.

6. Communication Conduct

Fludo is not responsible for inappropriate communication between users.
Upon receiving a valid complaint, we may ban the offending user.
No other liability applies.

7. Suspension & Termination

We may suspend or terminate your account for:

• Violating these Terms
• Misconduct
• Fraud
• Misrepresentation

We may do so without prior notice.

8. Limitation of Liability

To the maximum extent permitted by law:

• Fludo is not liable for any indirect, incidental, consequential, or punitive damages.
• Fludo's total liability is limited to the extent of banning an offending user upon verified complaint.
• All third-party services are used at your sole risk.

9. Indemnification

You agree to indemnify and hold harmless Fludo, its founders, employees, and affiliates from any claims arising out of:

• Your use of the platform
• Your interactions with Coaches, Merchants, or Organizers
• Your violation of these Terms

4. PARTNER AGREEMENT

This Agreement governs your participation as a Coach, Merchant, or Event Organizer ("Partner") on Fludo.

1. Platform Role

Fludo is a digital exchange facilitating communication and business interactions.
Fludo does not act as an agent, representative, guarantor, or service provider for any Partner.

2. No Minimum Business Commitment

Fludo provides no guarantee of:

• Revenue
• Leads
• Business volume
• Visibility

You acknowledge that all business outcomes depend solely on your efforts.

3. Quality of Goods & Services

You are solely responsible for the quality, safety, legality, and delivery of:

• Coaching services
• Events
• Merchandise

Fludo does not not guarantee or endorse any Partner's offerings.

4. Accuracy of Information

You are solely responsible for the accuracy of:

• Event details
• Product descriptions
• Coaching methodologies
• Claims, pricing, and promotional content

Fludo does not verify or validate Partner-generated content.

5. Communication & Conduct

Fludo is not responsible for:

• Inappropriate communication
• Harassment
• Abusive language
• Misconduct by Partners

Upon receiving a valid complaint, Fludo may ban the offending user.
No other liability applies.

6. No Responsibility for Ground Support

Fludo does not not provide:

• Event logistics
• Ground operations
• Physical support services

You are solely responsible for operational execution.

7. Platform Neutrality

Fludo does not:

• Promote any specific Partner
• Provide preferential treatment
• Influence user decisions

All Partners operate independently.

8. No Exclusivity

No Partner receives exclusivity unless a separate, written, signed agreement explicitly overrides this clause.

9. Data Usage & Restrictions

Partners may access:

• Anonymized demographic insights
• Trainee or participant data as permitted by users

You must not:

• Misuse data
• Export data
• Sell or resell data
• Use data outside the platform's intended purpose

Violation may result in immediate termination.

10. Indemnification

You agree to indemnify and hold harmless Fludo from any claims arising out of:

• Your services
• Your events
• Your merchandise
• Your communication with users
• Your breach of this Agreement

11. Limitation of Liability

To the fullest extent permitted by law:

• Fludo is not liable for any direct, indirect, incidental, or consequential damages.
• Fludo's sole obligation is limited to banning an offending user upon verified complaint.

12. Termination

Fludo may suspend or terminate your Partner access immediately for:

• Misconduct
• Misrepresentation
• Data misuse
• Violation of this Agreement
